§ 1 Scope
This Data Privacy Statement applies to the internet presence of Schütz Dental with all online content which is available at the domain www.schuetz-dental.de as well as at different subdomains (hereafter referred to as "our website").
§ 2 What is personal data?
Personal data is information that is used to identify you (e.g. name, address, phone no., date of birth, e-mail address). Information with no relation to your person (or which can only be related to your person with unreasonable effort), e.g. anonymized information, is not considered personal data.
§ 3 Which type of personal data do we collect, process and use?
We save access data with no relation to your person, such as the name of your internet provider, the website you are being referred to our website from, the names of any accessed files and the access date. This data is used and interpreted exclusively for the improvement of our website. It does not allow any conclusions concerning your person.
If you would like to make use of the services offered on our website, e.g. subscribing to our newsletter, etc. it is necessary to enter additional data. This includes all data necessary for us to provide the service, e.g. your e-mail address, if you subscribe to our newsletter.
We use the data collected about you for making available our products and services, for answering your questions as well as for the operation and improvement of our website.
Your personal data is not used for any other purposes. The transmission of your personal data to a third party or the use of your personal data for advertising purposes without your consent is excluded, except for the below listed cases and unless we are required to disclose personal data pursuant to applicable law (information requested by law enforcement authorities and courts of law, and by public institutions which receive data based upon legal provisions, such as social insurance agencies, finance authorities, etc.) or for the judicial assertion of our claims with help of third parties. In particular, personal data is used as follows:

When you first register at Schütz Dental, we only save your e-mail address to be able to send you access data, in case that you forget or lose it. In addition, we save your first name and family name and your password to make logging in more convenient. This data is used only for the prescribed purposes to offer this service.

This type of service allows the management of a database of email contacts, telephone numbers or any other contact information in order to communicate with the user.
The Services may also collect data about the date and time the message was read by the user, as well as when the user interacts with incoming messages, for example by clicking on links contained therein.

Brevo is a service provided by Sendinblue GmbH for managing email addresses and sending messages.

Management of user databases
This type of service allows the provider to create user profiles by first using the email address, name or other information that the user has submitted to this application, as well as tracking user activities through analytical functionalities. This personal data may also be matched with publicly available information about the user (such as social media profiles) and used to build a personal profile that the provider can view and use to improve this application.
Some of these services may also provide for the sending of timed messages to the user, such as emails, which this application associates with certain actions.

Conclusion of a contract for order processing
We have entered into a contract with Brevo in which we require Brevo to protect our customers' data and not to pass it on to third parties.
b) Contact form
If you use our contact form to send us a request, we will ask you to enter your name and e-mail address. You can enter a message to us in the comment field.
It is your decision whether you want to disclose this data. However, it is mandatory to enter it, if you would like to contact us.
§ 4 Use of cookies
We do not record personalized user profiles besides in the above listed cases. When you access information on our website, our servers only record anonymized data necessary for providing different services or for analysis. This means recording general information, e.g. which contents on our website were accessed and which pages were accessed the most.
We use so-called "cookies" (small text files with configuration information). Cookies are small text files which are sent from our webserver to your browser during your visit to our website and which are saved by your browser on your computer for a subsequent visit. We only use the so-called "session cookies" (also known as temporary cookies), which are only saved intermediately for the duration of your visit to our website.
All cookies serve the purpose of determining the frequency of use and the number of users. When you visit our website, they also trace your computer when moving from one of our pages to another and they record the end of your visit. The data the cookies collect will not allow any conclusions with regard to the user. None of the anonymized user data we collect are merged with your personal data in accordance with § 3 of this Data Privacy Statement. They are deleted immediately after the statistic analysis has been finished. The cookies are deleted when you finish your browser session.
In addition, we use affiliate cookies when a user accesses our website via an external advertising. Such cookies serve to determine the settlement for our cooperation partners and do not contain any personal data of the user. These cookies are deleted automatically after a maximum of 90 days.
Most browser presettings accept cookies automatically. It is possible, however, to change your browser settings to deactivate cookies completely or to have the browser ask before any cookies are stored. Users who deactivate the acceptance of cookies will not be able to access all areas of our web presence.
§ 5 Integration of Social Plug-Ins
Our website integrates plug-ins of the social networks "Facebook" (Facebook, Inc., 1601 S. California Ave., Palo Alto, CA 94304, USA) and "Twitter" (Twitter, Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA).
These plug-ins are operated solely by the respective providers. On our website, these plug-ins are made recognizable by a logo button.
When you visit one of our subpages which contains such a plug-in, your browser will connect to the according service. The content of the plug-in is then transmitted to your browser and it is integrated by your browser in the present page. This way, your visit to our website will be transmitted to the according social network. If you are logged in to your user account in the according social network while browsing our website (e.g. by means of two different browser sessions), the social network can match your visit to our website with your user account.
With help of the plug-ins, users can share or post links for the according websites on social media such as Twitter, Facebook or Google+1 respectively recommend the contents. By means of your active interaction with these plug-ins, e.g. by clicking the according button or leaving a commentary, this information is transmitted directly to each service and is saved there.

§ 6 Xing Plug-Ins
We use the "Xing" button on our website. When calling up this website, a brief connection to the servers of Xing AG (hereafter referred to as "Xing"), which supports the services connected with the "Xing" button, will be effected. Xing does not collect any personal data when you visit this website. Especially, Xing does not save IP adresses. Xing does not analyze your user behaviour by means of cookies in connection with the "Xing share button". § 7 LinkedIn Plug-Ins
We have integrated plug-ins of the social media LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA (hereafter referred to as "LinkedIn"). You will recognize the LinkedIn plug-ins with the LinkedIn logo and the "recommend" button on our website. When you visit our website, the plug-in sets up a direct communication between your browser and the LinkedIn server. LinkedIn receives the information that you have visitied our website with your IP address. This website uses Google Analytics, a web analyzing service of Google Inc. ("Google"). This website uses the chat function of the provider tawk.to. Cookies are necessary for the use of this function. tawk.to is an external service provider which provides us with the chat function and its administration. When using our chat, you automatically use tawk.to. All data that you enter in the chat window are automatically transmitted to tawk.to and are saved there. If you do not enter any personal data in the chat (e.g. real name, e-mail address, telephone no., etc.) it will not allow any conclusions on your person. Among the data that tawk.to saves are chat record, name entered, IP- address at the time of the chat and country of origin. This data is not passed on to third parties and are only saved for protection and for internal statistics. § 10 YouTube
We use embedded YouTube videos in advanced privacy modus. YouTube is a service provided by Google, Inc., Amphitheatre Parkway, Mountain View, CA 94043, USA.
YouTube provides the advanced privacy modus and thus ensures that YouTube will not save any cookies with personal data on your computer. The IP-address is transmitted when opening the website and when embedding videos. This address cannot be matched with your personal data, unless you are logged in temporarily or permanently to YouTube or any other Google service at the time of opening the website. As soon as you start an embedded video by clicking on it, because of the advanced privacy modus, YouTube will only save cookies on your computer that do not allow any conclusions on your person. § 11 Use of the Facebook Pixel
With your permission, we use the "visitor action pixel" of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook") within our web presence. With help of this service, we can trace user action after they have accessed or clicked a Facebook advertisement. This lets us determine the effectivity of Facebook advertisements for statistic and market research purposes. The data collected for us by this service is anonymized which means that we do not see any personal data of the users. However, we inform you in accordance with our level of knowledge that this data is saved and processed by Facebook. § 12 Use of Facebook Lead Ads
We use the function Lead Ads by Facebook Inc., 1601 South California Avenue, Palo Alto, CA 94304, USA ("Facebook"), to collect and process data of prospective customers (so-called "leads") by means of a contact form available of Facebook websites. moneymeets uses this data solely for their own marketing purposes and does not transmit them to third parties. Moreover, we use the Google service for interest-based advertising, the so-called Google Remarketing. Third party providers, including Google, place advertisements on websites on the internet. § 14 Safety Measures for the Protection of any Data Saved on our Servers
We are committed to protect your privacy and to keep your personal data confidential. To avoid a loss or abuse of the data we save, we take comprehensive technical and organizational safety measures which are checked and adapted to technological progress regularly. Please note, however, that it is possible that data privacy laws and the above listed safety measures are not be observed by other persons within the structure of the world wide web who are not within our area of responsibility. Especially, unencrypted data - even if it is sent by e-mail - can be read by third parties. From a technical point of view, we have no influence. It is the responsibility of the users to protect any data they provide from misuse by encrypting it or by any other means.
§ 15 Handling of applicants' personal data
You have the option to apply for our company's job openings (e.g. by e-mail, by standard mail or via our online application form). Below, we will inform you about the scope and the purpose of the collection of your personal data within the application process as well as about the use of this data.
We confirm that the collection, processing and use of your personal data is implemented in accordance with applicable data protection laws and with all other statutory provisions. Your personal data will be treated as strictly confidential.
Scope and purpose of data collection
After you send us your application, we will process all personal data connected with this application (e.g. contact information, communication data, files attached to the application, information noted down during interviews, etc.), as far as this is necessary for the decision about the establishment of an employment relationship.
The legal basis is § 26 BDSG-new under German law (initiation of an employment relationship), Art. 6 Sec. 1lit. b DSGVO (general initiation of a contract) and - as far as you have given your consent - Art. 6 Sec. 1 lit. a DSGVO. Your consent is revocable at any time. Within our company, your personal data will only be disclosed to persons directly involved with the processing of your application.
In case that your application is successful, your personal data will be stored in our data processing system for the purpose of establishing and maintaining an employment relationship. The legal basis for this data storage are § 26 BDSG-new and Art. 6 Sec. 1 lit. b DSGVO.
Data storage period
Should we be unable to offer you employment, should you decline our employment offer or should you withdraw your application, we reserve the right to store all data you have submitted for up to 6 months after the conclusion of the application procedure (rejection or withdrawal of the application). This data storage is based upon our legitimate interest according to Art. 6 Sec. 1 lit. f DSGVO.
After the expiration of this term, the data is deleted and all physical application documents are destroyed. The storage serves in particular for evidence purposes in the event of a legal dispute.
As far as it is obvious that keeping this data will be essential even after the 6 months term (e.g. due to an impending or sub judice lawsuit), we will not delete/destroy this data until the purpose for the extended storage ceases to exist.
Further reasons for an extended data storage could be your consent to this effect (Art. 6 Sec. 1 lit. a DSGVO) or statutory storage obligations which contradict a deletion.
Inclusion in our pool of applicants
If we can not offer you employment, it is applicable to include you in our pool of applicants. In case of an inclusion, all documents and information in your application will be added to this pool of applicants so that we are able to contact you in case of a suitable vacancy.
The inclusion in our pool of applicants is undertaken solely on the basis of your explicit consent (Art. 6 Sec. 1 lit. a DSGVO). Your consent is voluntary and has no bearing on the outcome of the application process. The person concerned can revoke their consent at any time. In this case, all the person's data is irrevocably deleted from the pool of applicants, unless there are legal reasons for the retention of this data. A person's data is irrevocably deleted from the pool of applicants at the latest two years after giving consent to data storage.
§ 16 Hyperlinks
Our website features so-called "hyperlinks" to the websites of other providers. When activating such a hyperlink, the user will directly be transferred from our website to the website of the according other provider. The user will recognize this transfer, amongst others, by a change of the URL. We cannot assume any responsibility for a confidential handling of your data on the websites of any third parties, as we do not have any influence on these third parties when it comes to their compliance with data privacy regulations. § 17 Revocation / Opposition

§ 18 Information on personal data, its storage period and its deletion
We only store your personal data as long as permitted by law. The personal data is deleted once the user revokes his/her consent or when the storage of the data is no longer necessary for the fulfillment of the pursued purpose, in particular, when the user account has been terminated or when the storage of the data is impermissible for any other reason.
Upon request, we are happy to provide information on which personal data has been saved. In case that, despite our efforts to always keep correct and up-to-date data, we have saved inaccurate data, we will correct it immediately. If you should wish that we delete the saved data, we will delete it promptly upon your request. In case that a deletion of your data is impossible for legal reasons, your data will be blocked to access instead. Please note, however, that we are unable to provide the above described services to you after we have deleted your data.
The data processed by us will be deleted or blocked to access in accordance with paragraphs 17 and 18 DSGVO (basic regulation for data privacy protection). If not explicitly declared within the scope of this Data Privacy Statement, all of your data collected by us will be deleted as soon as its storage becomes unnecessary for the purpose it was collected for and as long as there are no legally binding storage times to be considered. If data cannot be deleted because it is necessary for other purposes permitted by law, its processing will be limited, i.e. the data will be blocked to access and it will not be used for other purposes. Such a course of action is valid, e.g. for data which must be stored under commercial law or tax law.
Based upon legal regulations in Germany, data will be stored for 10 years in accordance with paragraphs 147 section 1 AO (German tax code), 257 section 1 no. 1 and no. 4, section 4 HGB (German code of commercial law) (accounts, records, management reports, vouchers, commercial accounts, taxation of relevant documents etc.) and for 6 years in accordance with paragraph 257 section 1 no. 2 and no. 3, section 4 HGB (commercial letters).
By sending us an e-mail at compliance@schuetz-dental.de, you have the option to check, to have us amend or to have us delete all of your personal data which has been stored by us. As far as it is possible and provided by law, we will delete the data that is not needed any longer.
§ 19 Right of Modification
The responsible authority reserves the right to modify this Data Privacy Statement at any time in compliance with the legal requirements.
